This notice describes our privacy policy and broadly pronounces how we handle the information we gather. 

1. Introduction

Interspace is an online platform and brand operated by NUI Contemporary Art Private Limited ("Company", "We", "Us", or "Our"), a private limited company, incorporated under the provisions of the Companies Act, 2013 and having its registered office at J-102 (New No. 97), Western Avenue, Sainik Farms, New Delhi – 110062, India. This Privacy Policy explains how we collect, use, store, disclose, and safeguard your personal information and sensitive personal data or information ("SPDI") when you visit or make a purchase through the Interspace platform and website ("Platform").

This Privacy Policy has been prepared in compliance with:

  • The Information Technology Act, 2000 (IT Act)

  • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules)

  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

  • The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020

  • Other applicable Indian laws and regulations governing data protection and privacy

By accessing or using Interspace, you consent to the collection and use of your information as described in this Policy. If you do not agree, please discontinue use of the Platform.

2. Definitions

"Personal Information" means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person — as defined under the IT Act.

"Sensitive Personal Data or Information" (SPDI) means personal information consisting of passwords; financial information such as bank accounts, credit/debit card details, other payment instruments; physical, physiological, and mental health conditions; sexual orientation; medical records and history; and biometric information — as defined under the SPDI Rules, 2011.

"Data Principal" means the individual to whom the personal data relates.

"Data Fiduciary" means the Company, which determines the purpose and means of processing personal data.

3. Information We Collect

3.1 Information You Provide

When you interact with Interspace Platform, we may collect the following personal information that you voluntarily provide:

  • Full name, email address, and phone number

  • Shipping and billing address

  • Purchase history and transaction details

  • Communications and correspondence with us

  • Account registration details (where applicable)

3.2 Sensitive Personal Data or Information (SPDI)

We may collect the following SPDI, processed solely through RBI-authorised third-party payment gateways:

  • Financial information such as bank account details or credit/debit card information, for the sole purpose of processing transactions

We do not store, retain, or process sensitive financial information beyond the transaction flow. Payment data is handled entirely by the payment gateway provider in accordance with applicable PCI-DSS standards and RBI regulations.

In accordance with Rule 5(1) of the SPDI Rules, 2011, SPDI is collected only with your prior informed consent and for a lawful purpose connected with our Platform’s activities.

3.3 Automatically Collected Technical Information

We automatically collect certain technical information when you access the Platform, including:

  • IP address and approximate geolocation data

  • Browser type, version, and language

  • Device type, operating system, and hardware information

  • Pages visited, time spent, and browsing behaviour on the Platform

  • Referring URLs and exit pages

This information is collected through cookies and similar tracking technologies, as described in Section 6 below.

4. Purpose and Lawful Basis for Processing

We collect and process your personal information for the following specific, lawful purposes:

  • Processing, confirming, and fulfilling orders and transactions

  • Communicating with you regarding purchases, inquiries, or complaints

  • Providing customer support and resolving grievances

  • Improving the functionality, performance, and user experience of the Platform

  • Sending order updates, shipping notifications, and transaction-related communications

  • Sending promotional and marketing communications, where you have opted in to receive such communications

  • Preventing fraudulent transactions and ensuring the security and integrity of the Platform

  • Complying with applicable legal obligations, regulatory requirements, and lawful requests from competent authorities

  • Maintaining business records, accounting, and audit trails

We reserve the right to ask you, at the time of registration with the Platform or thereafter, for documentary proof of your identity or other data provided by you with respect to the registration or otherwise. In the event that you fail to provide us with this information or documentary proof, we reserve the right to refuse registration or to terminate your user agreement immediately and cease to provide any services to you. You have the right to withdraw consent at any time by contacting us at collect@interspaceart.com; however, withdrawal of consent may affect your ability to transact on the Platform.

5. Sharing and Disclosure of Personal Information

We do not sell or rent your personal information to third parties. We may, however, share your information with:

  • Payment processors and banking partners, for transaction processing

  • Logistics and delivery partners, for shipping and delivery of artworks

  • Website hosting, cloud storage, and IT service providers

  • Analytics and digital marketing service providers, where you have consented to such use

  • Legal and compliance advisors, where necessary

All third-party service providers are engaged under appropriate data processing agreements and are permitted to use your data only to the extent necessary to perform their contracted services.

We may also disclose your information to: comply with any applicable law, court order, or legal process,  enforce our Terms and Conditions or protect our rights, prevent fraud, criminal activity, or threats to safety, and, in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality obligations

The Company takes care to distinguish between information that is made publicly visible as part of an artist’s profile or artwork listing and information that is retained privately for operational, contractual, or financial purposes. Sensitive information, including financial and contractual details, is handled with appropriate confidentiality.

6. Cookies and Tracking Technologies

Interspace uses cookies and similar tracking technologies to enhance user experience, analyse platform traffic, and personalise content. The categories of cookies used include:

  • Essential / Strictly Necessary Cookies: Required for the basic functioning of the Platform (e.g., session management, shopping cart)

  • Analytics Cookies: Used to understand how users interact with the Platform (e.g., pages visited, time spent)

  • Marketing / Preference Cookies: Used to deliver relevant content and, where consented to, personalised advertising

You may modify your browser settings to refuse or delete cookies. Doing so may affect the functionality of certain features of the Platform. 

7. Data Retention

We retain personal information for as long as you engage our services and for as long as is necessary and a reasonable period thereafter to fulfil the purposes for which it was collected, which includes:

  • Completing and documenting transactions

  • Maintaining business and accounting records as required under the Companies Act, 2013 and GST laws

  • Complying with statutory retention obligations under applicable Indian law

  • Resolving disputes and enforcing agreements

8. Data Security

We implement reasonable technical and organisational security measures to protect your personal information from unauthorised access, disclosure, alteration, or destruction, in compliance with Rule 8 of the SPDI Rules, 2011.

While we strive to maintain robust data security, no method of electronic transmission or storage is entirely secure. We cannot guarantee absolute security of your data, and we disclaim liability for any breach that occurs despite our reasonable security measures, to the extent permitted by applicable law.

In the event of a data security breach affecting your personal data, we will notify affected users in accordance with applicable law.

9. Your Rights as a Data Principal

Subject to applicable law, you have the following rights in relation to your personal information: You may request confirmation of whether we hold your personal information and obtain a copy of such data, request correction of inaccurate or incomplete personal information and request to withdraw consent to the processing of your personal information at any time, subject to legal or contractual limitations. You may request deletion of your personal information where it is no longer necessary for the purpose for which it was collected, subject to legal retention obligations. Complaints relating to data privacy will be acknowledged within 5 working days  and redressed within 30 days of receipt.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not operated by us. We have no control over and assume no responsibility for the privacy practices, content, or security of such third-party sites. We encourage you to review the privacy policies of any third-party website or service you visit before providing any personal information.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our data processing practices, technology, or legal requirements. Any such modifications will become effective immediately upon posting to the Platform and your continued use of the Platform, and/or the services constitutes your consent to such modifications. If you object to any changes, you may close your account.We encourage you to review this Policy periodically.

13. Governing Law and Jurisdiction

This Privacy Policy is governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with this Privacy Policy that are not resolved amicably shall be subject to the courts of New Delhi.
